Welcome to Blimp. These Terms of Use ("Terms") govern your access to and use of the Blimp platform at we-blimp.com & we-blimp.tech (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Who operates Blimp

Blimp is in the process of being incorporated as Blimp GbR (in Gründung), founded by Diana Aya and Liubov Höpfner. These Terms will be updated to reflect the new entity once registration is complete; your relationship with the Service will continue without interruption.

2. Description of the Service

Blimp is a guided validation platform that helps first-time founders structure, validate, and develop early-stage business ideas through an interactive canvas, AI-assisted analysis, access to expert advisors, and related tools.

3. Eligibility and accounts

  • You must be at least 18 years old to create an account.

  • You are responsible for keeping your login credentials secure and for all activity under your account.

  • You agree to provide accurate information when registering.

4. Beta access and free plans

  • Blimp is currently in a closed beta. Access may be limited and granted via invitation, application, or access codes.

  • Beta and free-tier users may be given temporary free access to features that are otherwise part of paid plans (e.g., a free period via an access code). The duration and scope of this access will be communicated at the time it is granted.

  • We may modify, suspend, or end beta access at any time, with reasonable notice where possible.

5. Your content

  • You retain ownership of the ideas, business information, and other content you input into Blimp ("Your Content").

  • You grant Blimp a limited license to process Your Content solely to provide the Service to you — for example, to display it back to you, run AI-assisted analysis at your request, or share it with collaborators you explicitly invite.

  • We do not sell, share, or distribute Your Content to third parties for marketing or other purposes, and we do not use Your Content to train AI models.

  • We do not claim ownership of your business ideas.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose

  • Attempt to gain unauthorized access to other accounts, systems, or data

  • Reverse-engineer, scrape, or interfere with the Service

  • Upload content that infringes the rights of others or violates applicable law

7. Intellectual property

The Blimp platform, including its software, design, branding, and content (excluding Your Content), is owned by Diana Aya / Blimp GbR (in Gründung) and protected by applicable intellectual property laws. You may not copy, modify, or distribute it without permission.

8. No professional advice — use at your own responsibility

Blimp provides tools, frameworks, and AI-assisted suggestions to support your thinking. It does not constitute legal, financial, tax, or investment advice, and any business decisions you make based on the Service are made at your own discretion and responsibility. We strongly recommend consulting qualified professionals before making significant business or financial decisions.

9. Limitation of liability

To the extent permitted by law:

  • For paid users, our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months prior to the claim.

  • For free or beta users, our total liability is limited to €100.

  • We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities, arising from your use of the Service or decisions made based on it.

Nothing in these Terms excludes liability that cannot be limited under applicable law (e.g., liability for intent or gross negligence).

10. Payments and subscriptions (applies once paid plans launch)

  • Paid plans, when introduced, will be billed in advance (monthly or for longer periods, as offered).

  • Payments are processed via Stripe.

  • Subscriptions auto-renew unless cancelled before the next billing date.

  • Refunds are handled case-by-case at our discretion.

  • All prices are stated in EUR and include German VAT (Umsatzsteuer) at the applicable statutory rate, unless stated otherwise.

11. Accelerator and B2B agreements

Access provided through an accelerator, incubator, or similar partner organization may be subject to additional terms agreed directly between Blimp and that organization. Founders using Blimp through such a program may have different terms communicated to them directly.

12. Account termination

We may suspend or terminate accounts that:

  • Violate these Terms

  • Engage in fraud, abuse, illegal activity, or actions harmful to other users or the Service

  • Are inactive for an extended period (with prior notice where reasonable)

You may delete your account at any time via your account settings.

13. Changes to these Terms

We may update these Terms as Blimp evolves. We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is Berlin, to the extent legally permissible.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
